The theory of the case is that each online delivery platform (“Platform”) has imposed rules on you, as the merchant restaurant, to limit price competition between the other Platforms. In particular, the Platforms have imposed rules that mandate that:

i) The prices restaurants charge customers who order through one Platform cannot be higher than prices charged to customers who order through any other Platform; and
ii) Restaurants cannot offer discounts from their list prices to customers who order directly from the restaurant (whether for takeout, delivery, or dine-in), even though these orders cost the restaurants less than Platform orders.

The rules directly restrain the incentives and the ability of each Platform to compete against each other on price, resulting in you paying unfairly high commission prices, and losing revenue as a result of their elimination of your right to discount direct takeout and dine-in orders.

You will not be responsible for paying any legal fees unless there is a recovery or settlement. Those fees will be deducted from any recovery or settlement.

We believe the claims are strong, but we cannot predict the odds of recovery at this time.
